16th EAAC Terms & Conditions
1. Terms of Reference
For the purposes of the terms and conditions herein, the term “the Organizer” shall mean Actuarial Society of Malaysia. The “Conference” herein refers to the 16th East Asian Actuarial Conference 2011 (16th EAAC) (including the Welcome Reception and Farewell Dinner & Tour).
The “Event Venue” refers to the Shangri-La Hotel, Kuala Lumpur.
The “Conference Date” refers to 10th – 13th October 2011
2. Application for Conference
The submission of the Conference Registration Form (“Form”) shall be deemed as an acceptance of the terms and conditions herein by the delegate. The application procedure is complete only when the registration form and payment are received by the Organizer.
3. Payment
a. Full payment is required with your registration form. Confirmation of registration is only upon receipt of full payment. Conference fees include admission to Conference sessions, lunches, coffee breaks, registration materials, Farewell Dinner, Welcome Cocktail & City Tour (Optional). The accompanying person’s rate gives access to the Farewell Dinner & City Tour (Optional). Golf Tour package is optional and a separate fee is chargeable. Details of City Tour & Golf Tour will be available on the website once confirmed.
b. All registration forms and payment MUST reach the 16th EAAC Secretariat by 26 September 2011.
c. Payment must be made in full upon submission of the registration form. Final deadline for submission of the registration form is 26 September 2011.
d. Payment may be made by the following payment modes:
i. Corporate/company cheque (payment in MYR for Malaysia-based companies only)
ii. Bank draft
iii. Telegraphic transfer (Finance Charge: USD 25/MYR 80 per transaction)
iv. Credit Cards (Visa & Mastercard only)
16th EAAC Credit Card charges will be billed by our service provider, CIMB Bank Berhad. All credit card charges are in MYR only.
A copy of payment slip must be emailed to us at admin@actuariesasia.org or faxed over to 603-78779458 as proof of remittance.

e. The Organizer is not responsible for covering any airfares, lodging or incidental costs incurred by delegates.
f. The Organizer reserves the right to review and amend the currency exchange rate as applied herein when necessary. Any changes in exchange rates will be reflected on the e-brochure and relevant pages on the website located at www.actuariesasia.org and those rates will prevail.
4. Cancellation/Postponement of the Conference
a. If, for any reason, the Conference, or any part thereof, is prevented from being held, or the Event Venue becomes unavailable the Organizer may cancel or postpone the Event. In such event, the Organizer shall not be responsible for delays, damage, loss, increased costs, or other unfavorable conditions arising by virtue thereof, and the delegate(s) waive(s) claims for damage against the Organizer arising there from.
b. Payment once made will guarantee a place in the conference, hence it will not be refunded in the event of a cancellation by delegate. If the delegate is unable to attend the Conference, a substitute delegate is welcomed at NO extra charge provided written notification is given to the Organizer prior to the Conference Date. Deadline for submission of name for replacement is 26 September 2011.
5. Change of Conference Date, Speakers, Programme Content and Venue
The Organizer reserves the right to change the Conference Date, speakers, programme content and Event Venue should circumstances so require.
6. Refusal of Admission
The Organizer reserves the right to refuse admissions or remove any person from the Exhibition at its absolute discretion, without incurring any liability whatsoever. This will include anyone deemed drunk, disorderly, under the influence of drugs, other than that medically prescribed, or whose dress appearance or general behavior is liable to disturb any Exhibitor or persons attending the Conference.
7. Venue Regulations
The delegate(s) shall abide by the Rules and Regulations of the Event Venue. Failure to comply with the Rules and Regulations will constitute grounds for breach of the terms and conditions herein. A copy of the Rules and Regulations may be obtained from the Organizer.
8. Breach of Terms and Conditions
In cases where the delegate(s) fails to observe and perform any of the terms and conditions herein, the Organizer shall reserve the right to refuse performance of all its obligations herein towards the delegate(s) and all fees paid by the delegate(s) to the Organizer will be forfeited. The delegate(s) shall furthermore indemnify the Organizer for all losses and damages resulting from such failure in observing or performing the terms and conditions herein.
9. Exclusion of Liability
The Organizer, its sub-contractors, agent and/or employees have the right to immediately alter or cancel the Conference or any arrangements, timetables, plans or other items relating directly or indirectly to the Conference. The delegates shall not be entitled to any compensation for damages that result from such alteration or cancellation. Furthermore, neither the , its sub-contractors, agent and/or employees shall at any time be liable for any loss, damage or injury whatsoever , howsoever suffered by any of the delegate(s) or any loss or damage to property of any delegate(s) arising form or in connection with his/her participation in the Conference.
10. Force Majeure
The Organizer shall not be liable for any delay or failure to perform its obligations under the terms and conditions herein due to circumstances beyond the control and without the fault or negligence of the Organizer including war (declared or undeclared), natural disaster, acts of God, fire, blockades, earthquakes, acts of terrorism and matters beyond the Organizer’s reasonable control.
11. Interpretation, Governing Law and Jurisdiction
Interpretation of the terms and conditions herein lies solely with the Organizer. The terms and conditions herein shall be governed by and construed according to Malaysian law. The parties hereto hereby agree to submit to the exclusive jurisdiction of the Malaysian courts.
12. Successors in Title and Lawful Assigns
The terms and conditions herein shall be binding upon the parties, its successors in title and lawful assigns.
